Applicability of the terms and conditions
These general terms and conditions are, to the exclusion of all others (including those of a later date stated on any (electronic) document issued by Muchmore Styling), of applies to the legal relationship between every visitor and user (which also includes a buyer of a good sold on the web store) of the Muchmore Styling web store as well as on any delivery as a result of a purchase made on this web shop.
When placing an order, the end user is obliged to tick the box provided for this purpose, thereby indicating that he has read these general terms and conditions of sale and accepts them in full. Also making a deposit declares to agree with the General Terms and Conditions of Muchmore Styling.
Muchmore Styling may amend these general terms and conditions of sale at any time, but it is the general terms and conditions of sale in force at the time of the conclusion of a sales agreement between the end users and Muchmore Styling that further govern their agreement.
This webshop is limited to the geographical continent of Europe. Therefore, Muchmore Styling’s offer only applies to end users who have a delivery address located on European territory.
Material application area
This webshop is aimed at end users and entrepreneurs who will serve as franchisers under the name of Muchmore Styling. Sale to persons (of any kind) who purchase with intent to resell is not excluded for this reason. Muchmore Styling reserves the right to request additional information in order to determine the purpose of a (request for) sale and to refuse a (request for) sale for which it has reason to believe that it has been concluded for this purpose .
The sales agreement can be concluded in Dutch and English according to the choice of the customer. The further data exchange will then be continued in the selected language. Since the end user has to make a choice of language, after this choice he will no longer be able to rely on lack of knowledge of this language to invoke the non-applicability of the sales agreements, these general sales conditions (or parts thereof).
Only European law applies to this agreement. Any disputes in connection with its creation or implementation can only be brought before the courts.
The conclusion of the agreement
The sales agreement between Muchmore Styling and the end user is only concluded at the time that Muchmore Styling has confirmed it via confirmation email. The absence of an ordinary signature does not affect the binding force of the agreement. The sales agreement will always be maintained by Muchmore Styling and by the customer himself.
Muchmore Styling reserves the right to request additional information from the end user before concluding the sales agreement (and thus to confirm it), or to refuse it.
Muchmore Styling also reserves the right to subject the conclusion of a sales agreement to additional conditions to be determined by Muchmore Styling in the event of large orders, orders by minors, incomplete ordering procedures or in the event that problems have arisen earlier between Muchmore Styling and agreements concluded with the end user.
Also in the event that Muchmore Styling requests additional information or establishes conditions, the sales agreement will only be concluded after the end user has accepted these conditions and a confirmation email has subsequently been sent by Muchmore Styling.
Payment and transfer of ownership
Payment for the products is only accepted by the following means of payment: VISA/MASTERCARD/BANCONTACT/İDEAL. To ensure a secure online payment and the security of your personal data, the transaction data is sent over the internet encrypted with SSL technology. You do not need any special software to pay with SSL.
If, for whatever reason, a payment should be canceled afterwards before the delivery has taken place, Muchmore Styling will have the choice to continue the sale, however without prejudice to the existing right of withdrawal of the end user, or to be legally dissolved. In any case, an order will only be executed after a valid and full payment has been received. Transfer of ownership as well as risk takes effect at the time of delivery of the ordered merchandise.
Delivery and delivery times
The delivery time is a maximum of 7-10 weeks. In the confirmation email, Muchmore Styling will indicate the date on which the delivery will take place. In order to ensure that the delivery runs as smoothly as possible, the transport service will contact the customer by telephone (preferably mobile) the day before the delivery in order to indicate the time within which the delivery will take place. The telephone coordinates will only be used for delivery purposes and will under no circumstances be passed on to third parties.
Deviations from the agreed delivery date or the delivery address can be adjusted at the latest two weeks before the planned delivery date by means of telephone contact. For late postponement, please contact firstname.lastname@example.org and a delivery cost of €1 per km will be charged.
If you are not present on the agreed date to receive the goods and a second delivery is necessary, you must agree a new date via email@example.com. An additional transport cost of € 75 will be charged for this.
The end user declares to have taken note of Muchmore Styling’s “home delivery tips” in which the method of delivery is explained and in which tips are given to ensure that the delivery runs as smoothly as possible.
The end-user does not have a statutory cooling-off period for all products purchased on the Muchmore Styling web shop. This in connection with special custom-made products that have been created by Muchmore Styling in accordance with the specifications of the buyer.
The consumer handles the product and the packaging with care. He will only unpack or use the product to the extent necessary to determine the nature, characteristics and functioning of the goods. Muchmore Styling reserves the right not to refund any depreciation resulting from handling the goods beyond what was necessary to establish the nature, characteristics and functioning of the goods. In case of defects or damage, you can always contact Muchmore Styling.
In the event of damage and/or defects, the goods must be returned at the expense of Muchmore Styling undamaged, in original condition and in original packaging at the latest within 14 calendar days after delivery. The shipping date serves as a check. All accompanying documentation, warranty certificates and packaging materials must be included with the complaint. Muchmore conducts expert opinion on complaints, breakages or damage and will then come up with a proposal to harm the customer as little as possible.
The exercise of the right of renunciation can be sent to the physical address of Muchmore Styling, stated on the quotation form. Goods can be returned to the stated physical address or electronically to firstname.lastname@example.org . Muchmore Styling can be reached by phone and by appointment. If the consumer has opted for a method of delivery other than the cheapest standard delivery offered by the company, the resulting additional costs will not be refunded.
Information, images, verbal announcements, statements, etc. with regard to all offers and the most important characteristics of the products that are provided (in whatever way) are done as accurately as possible. Muchmore Styling is not liable for advice, printing and typing errors on the website or technical data provided by suppliers or producers. Availability is indicated for every product that is offered for sale online. Muchmore Styling makes every effort to display this information correctly and up to date on the website, but it may happen that a certain product cannot be delivered for the time being. This may be the result of (involuntarily stated) incorrect stock data or of suppliers who are (temporarily or otherwise) in a situation where they can no longer proceed with delivery. Should such a case arise, Muchmore Styling will make every effort to notify the end user as soon as possible and propose a solution.
Warranty conditions A warranty period of 2 years after delivery applies to each product. This period commences on the day after delivery to the delivery address as specified in the order form. The receipt (or invoice) and the delivery note are the only form of guarantee certificate and must be able to be submitted in order to be able to claim under the statutory guarantee scheme. Business sales are excluded from this warranty scheme.
Upon delivery, the end user must always state any visible damage (including: damaged packaging) on the delivery note. Failing this, complaints about visible damage will no longer be accepted.
If, after delivery, the end user discovers a shortcoming or damage when opening the packaging, this must be reported in writing within 72 hours after delivery of the goods via email@example.com. The details of the receipt/delivery note will be requested when filling in the form. Attaching photos is required to ensure smooth processing. Complaints outside this 72-hour period will no longer be accepted, without this affecting the right of withdrawal in itself.
Force of the majority In the event of a force majeure situation, the delivery and other obligations of Muchmore Styling will be suspended during the period in which this force majeure situation lasts. This also applies if this situation would only arise after the delivery period had already expired.
If this period of force majeure lasts longer than 20 weeks, both parties can choose to consider the agreement as dissolved, subject to written notification, without Muchmore Styling or the end user owing each other compensation.
Force majeure is understood to mean any circumstance independent of Muchmore Styling’s will, as a result of which the fulfillment of its obligations towards the buyer is wholly or partially prevented or as a result of which the fulfillment of the obligations cannot be reasonably expected from Muchmore Styling, regardless of whether that circumstance was foreseeable at the time of the conclusion of the agreement. Force majeure shall in any event also include: war, danger of war, mobilization, riots, flooding, storm damage, transport disruptions, stagnation in, or limitation or cessation of supplies by public utilities, fire, machine breakdown and other accidents, strikes, exclusions, import and export bans, actions by employees’ organizations that make the execution of an order impossible, government measures, non-delivery of products to Muchmore Styling by third parties and other unforeseen circumstances, also in the country of origin of the products, which disrupt normal business operations and delay or reasonably make the execution of an assignment impossible.
Prices All prices are expressed in EURO and include VAT but without shipping and transaction costs. Any shipping costs are the responsibility of the buyer and are shown in the order overview. Muchmore Styling may adjust prices at any time (without prejudice to orders already placed). Promotions on articles are only valid under the conditions and for as long as they are posted on the webshop.
Intellectual Property Rights
References The contents of the Muchmore Styling webshop, including brands, logos, drawings, data, product or company names, texts, images, etc. are protected by intellectual rights and belong to Muchmore Styling or other entitled third parties. Reproduction and/or use are not permitted.
It is possible that Muchmore Styling includes links on its website to other websites that may be interesting or informative for the visitor. Such links are for informational purposes only. Muchmore Styling is not responsible for the content of the website referred to or the use thereof.
